I was arrested by the Dwp and police for staying at my girlfriends can they charge me?

I pay my council tax and buy my own food at my brothers house a mile away and i stay at my girlfriends 3 or 4 nights a week I don't contribute to her bills she lost her job in the recension last year and is on benefits
